Study On The Construction Of The Implementing Subject Of Community Correction In China

The concept of community correction was introduced into China at the end of last century.The community correction system was officially tested from the year of 2003 and was gradually extended to the whole country.Up to the present,this system has been implemented for 13 years.In 2014,Suggestions on thouroughly implementing community correction was jointly issued by the Supreme People's Court,the Supreme People's Procuratorate,the Ministry of Public Security and the Ministry of Justice,which marked the community correction had been thouroughly extented.The implementation of community correction system is a major step of execution of punishment reform.It has significant meanings on strenghening our justice system.For the past 10 years,the theoretical field has made a lot of advanced multi-angle study on the community correction,especially its loaliztion access.Practical field has also persevered in research by overcoming difficulties,they obtained achievements and gained rich experience.It takes a long time to create and implement a new system,compared to hundreds of years of experience of similar system in western countries,this system is still very young in our country,therefore there are many aspects need to be improved in this system,while these problems will become more obvious when the practice goes deeper and deeper.Among them,not having a clear understanding of the naure of the system,not having a clear implementing subject of the system,seriously insufficient implementation force,etc.,have become the major limitations of the development of the system,and need to be improved as soon as possible,to ensure the authority and security of the system.Therefore,this paper is based on the implementing subject of the Community Correction system,and is going to discuss the solutions and suggestions to improve the system in four segments.Firstly,it begins with the basic theory of community correction and its implementing subject,through detailed analysis of the nature and characteristics of the system,and raise the question of "What kind of implementing subject of the community correction system we should build?" Secondly,review the related laws and regulations of the system,and the development process of the system in our country,and try to find out a praticable solution by analyzing the implementing subject of community correction and its existing problems,based on the experience of the related departments.Thirdly,try to get some inspirations through a brief analysis of the similar system in USA,Japan,and Taiwan,and based on the real situation of our country.Finally,try to find out some solutions to improve the system of implementing subject of community correction in our country,from the aspects of confirmation of the implementation entity,organization setting,team building,and the participation from the society.The author has been working in this field for many years,and realizes the significance of the improvement of the system,and hopefully through this paper she can contribute to the improvement of the system.
