A Study On The Problems, Causes And Countermeasures Of Implementing Community Correction System In Guizhou Province

Community correction is a new criminal justice system in China, shining with humanity, democracy, efficiency, harmony and other brilliant penalty spirits, which needs the theory, practice and other aspects of the in-depth systematic summary after more than ten years of development and trial. On the basis of empirical research, it summarizes the problems existing in the execution of community correction in Gui Zhou and tries to combine the actual situation with the advanced experience of other provinces, thus putting forward the solution. In this paper, the text is divided into the following four parts:The first part analyzes the fundamental problems of the community correction. This part mainly discusses the concepts of the community correction at home and abroad, and deep mines community correction system’s justice, human rights and other theoretical basis, exploring its function on the power restriction, application of the rule of law, and efficiency promotion.The second part is a review of the implementation of community correction system in Gui Zhou. This part firstly introduces the research background, and then shows the survey data. A lack of judicial credibility in penalty execution procedures, punitive legal consequences in judicial enforcement,security in community inmates regulation and a scientific assessment system of rewards and punishment system, these are the existing obstacles and difficulties.The third part depth analyzes the reason of the problems in community correction of Gui Zhou province. The traditional doctrine of severe punishment thought influences people’s concept. Few social forces have participated in community correction. The system operation conditions and basis are physically limited. A unified and effective procedure specification has not yet been established in law.The fourth part puts forward some countermeasures and suggestions to perfect the system of community correction in Gui Zhou. This part is divided into the basic principles, the specific contents and measures three blocks. The author puts forward to establish the basic principle of division in charge and close collaboration incorporation. From the perspective of community correction program execution, the author puts forward to construct judicial credibility, establish enforcers’ legal responsibility, strengthen procuratorial supervision, regulate the supervision and administration of community execution and improve the system of scientific assessment of rewards and punishments. Supporting measures mainly focus on guaranteeing basic conditions and promoting community construction two aspects.
