The Research Of Legal Regulation Of Administrative Normative Documents

In today's society, with the continuous development of society, the social management affairs becoming more multifarious, government administrative function correspondingly expands increasingly, administration according to law will naturally become an important part of construction of the socialist country ruled by law. Nowadays, with the increasingly emphasis on the administration by law, the abstract administrative action is an important means of exercising the executive power by the state administrative organs. Its object is not certain, influence is very extensive, and it can be exercised repeatedly. These characteristics are required to be included in the orbit of legal system in China. Otherwise, people will have on laws to depend on, people's behavior will be out-of-order and social will must be in chaos.In the administrative management, administrative normative documents with the huge number, and closer relation to the rights and obligations of the citizens are the important tools of government administration, they play an important role in our socialist legal system. However, because our government did not give enough attention to administrative normative documents both in legislation and in the academic circle, thus administrative normative documents have many problems on the definition, formulation, implementation and supervision. The phenomena of infringing citizens' rights and lawbreaking by administrative normative documents is becoming more common. How to implement effective supervision and management to administrative normative documents and ensure administrative organs executed in accordance with law become a difficult problem in the current social reality.Therefore, this paper emphatically study the legal regulation system of administrative normative documents, starting from the basic theory of it, aiming at the existing problems, learning inter-external effective regulation experiences, then putting forward tentative plan of legal regulation from the legislation based on theory of administrative law. I hope this paper can help to achieve the goal of administrative management, in order to better safeguard the lawful rights and interests of citizens.
