Nowaday, sexual harassment in the workplace becomes a widespread social problem around the world. From the perspective of our county, as people increase the awareness of the rights, sexual harassment in the workplace has become the subject of attention. In recent years, as the cases of sexual harassment in the workplace are raising, it obtains extensive discussion and more attention by society. However, there are several problems in front of the judges due to the imperfect provisions of relevant legislation in the workplace sexual harassment, such as different awareness of sexual harassment in the workplace and different standards to apply. In order to solve these problems as well as provide a more adequate theory to support practice, we should recognize the national circumstances, and actively learn from advanced foreign experience in legislation to enrich our laws with a fast speed. So that to protect the interests of victims, maintain a normal workplace order and social harmony and stability, promote the development of society under favorite and harmonious conditions. This article researches on the issues of workplace sexual harassment, and provide recommendations to make some improvement to handing such cases.In addition to the introduction and epilogue, this article is divided into four parts:The first part is issues. This section briefly describes a case and the case causes sorts of the problems:why should establish the regulations of sexual harassment in the workplace? How to define sexual harassment in the workplace? Who is responsible for sexual harassment in the workplace?The second part is the necessity of regulations of sexual harassment in the workplace. In this part three main aspects are discussed to explain the significance.The third part is defining the concept of workplace sexual harassment. Firstly, four aspects interpret the concept of sexual harassment in the workplace. And then, it analyzes the legal characteristics of sexual harassment in the workplace. Finally, classifies sexual harassment in the workplace, intended to solve the following problems.The fourth part is the liability of sexual harassment in the workplace. This section is the focus of the paper, as reflect for example to analyze and solve problems. The basic structure is the first acts of sexual harassment in the workplace were clear accountability, and accountability methods, and then describes the relevant domestic legislation on employer liability, and find out the establishment of China's national conditions for employer liability method, in order to protect victims, The establishment of employer liability in China to make some recommendations.
