| As one kind of public nuisances, false news has caused the attention and condemnation of scholars in news media for a long time. However sort out in the past, false news appears in newspapers now and then. Therefore, how to eliminate false news and to give back the truth of news is an immediate problem. The legal sociology benefits a lot for many social issues with its advantages in legal and sociological theories, that is especially true of the false news phenomenon, which is closely correlated with society. This paper, within the framework of sociological theory such as the theory of social change and the methodology of legal sociology, theoretically discusses the emergence of false news and comes up with schemes in administering false news.Chapter 1:covers the connotation of false news, the reason why there are false news, the history of false news and the underlying legal roots. The theory of social change mainly focuses on the passage from traditional society to modern legal society. This chapter emphasizes the effects of legal factors upon false news during the late Qing Dynasty, the Republican period and the period before CCP was in power and thereafter.Chapter 2:the advantages of state law is once again highlighted with the more fierce momentum of false news. The intervention of the State Law will inevitably lead in the conflicts with press freedom in the news media. How to solve the conflicts is the main part that will be probed into.Chapter 3:this chapter, following the same theoretical logic in chapter 2, introduces the legal responsibility into the behaviors of producing and spreading false news. Illegibility will be recognized not only from theory and also from true life. From two perspectives of legal responsibility and exemption from legal responsibility, chapter 3 expects to clarify the legal responsibility within limited content.Chapter 4.:The solution to false news not only reflects the appeal of legal sociology theory but also the urgent need of true life. Based on the previous chapters about eliminating false news and in order to clarify the orientation of administrating false news, this chapter tentatively sets up the choosing standards and discusses the administration of false news in great detail. |
