Shandong Liberated Areas Of Marriage Legislative Studies

In the Chinese feudal society of 2000 years,the feudal marriage system centered on male,which developed from the traditional peasant economy,projects profound influence on the old even the modern society of China. But since the Opium War, the introduction of some western advanced ideas (especially the idea of advocating freedom of marriage, women's liberation, equality of men and women, and so on), injects fresh blood to the traditional marriage system, and urge the revolution of it. During the Anti-Japanese War and the liberation war, the Chinese communist party also reform the old marriage system,but at that time the priority is to defeat the Japanese army,and the construction of marriage law must obey the overall atmosphere. Once the marriage system construction affects the overall interests of the anti-Japanese war, the government had to make some adjustments in policies,modes and intensity, and this is a characteristic of the construction of marriage law during anti-Japanese war.Shandong liberated area is one of the main revolutionary bases of our party, its marriage legislation is no doubt significant. It can not only embody the great achievements of the early marriage law construction of our party, but also show some rule of the marriage law of our party during the new- democratic revolution, besides, it enriches the research of Shandong history and manifests enthusiasm and thoroughness of Shandong people to revolution. This paper uses the marxist historical materialism viewpoint, adopts the research method of literature, history, analysis and induction, bases on the existing researches, analyses the reasons of its implementation by researching the contents and features of the marriage law system in Shandong liberated areas by reading a lot of historical data, then further arrives at the historical status and limitations of the marriage law of Shandong liberated areas. Especially, the study of the particularity of the marriage law construction of jiaodong area in shandong, reflects our party's spirit of being practical and realistic and analysing concretely in making policy. This text will discusses it from four aspects. The first part, "the historical origin of the marriage law of shandong revolutionary bases ", investigates the basis of marriage law construction respectively from the three stages of the Chinese traditional marriage legal system, Chinese modern marriage legal system and central base area marriage legal system of Shandong revolutionary bases.The second part, "the content of the marriage legal system construction of shandong revolutionary bases ", mainly analyses from the profiles, principles, provisions of marriage and divorce and the protection of soldiers marriage, as well as the special regulations on marriage system of jiaodong areas.The third part, "the power of the marriage legal system construcion of shandong revolutionary bases ", uses a lot of historical data and the examples, explores the power of the establishment and implementation of marriage legal system in Shandong revolutionary base respectively from the economic, political, ideological and cultural aspects.The fourth part, "shandong base marriage legal system construction of historical significance and limitations of the marriage legal system construcion of Shandong revolutionary bases", analyses its tremendous role and limitations in shandong women's liberation, anti-Japanese War and the liberation war.
