Study On The System Construction Of Local Science And Technology Legislation

At present,information technology such as artificial intelligence,big data,and cloud computing has profoundly changed the economic and social development pattern,“gene editing baby” and tansgenic food also trigger conflicts between scientific and technological innovation and social ethics.Under the background of comprehensively governing the country according to law and new development concepts,it is of great significance to study and study scientific and technological legislation,especially local science and technology legislation.China has a vast territory,and its natural resources,environmental conditions,economic development level,and scientific and technological innovation capabilities in different regions have shown remarkable regional characteristics,it was decided to vigorously strengthen the local science and technology management work and its corresponding local science and technology legislation.In recent years,local science and technology legislation has accelerated significantly,initially forming a multi-level legal and regulatory system related to scientific and technological activities,but there are still many problems.We try to analyze and study the status quo,existing problems and ways and means of solving local science and technology legislation in China with scientific thinking,problem-oriented and dialectical methods.On this basis,we put forward some constructive thinking.The first chapter,under the guidance of the basic theory of local science and technology legislation,scientific analysis of the dialectical relationship between science and technology legislation and other legislation,local legislation and national legislation,local science and technology legislation and national science and technology legislation,it is concluded that the local science and technology legislation promotes the scientificization of local science and technology legislation planning,realizes the systemization of local science and technology innovation legislation,guarantees the innovation of local science and technology management system,and promotes the regionalized functional role of local science and technology legislation,then the basic principles that local science and technology legislation should adhere to are: scientific legislation,democratic legislation,legal legislation,and moderate advancement.The second chapter briefly analyzes the status quo of local science and technology legislation in China,and specifically studies the problems existing in local science and technology legislation in China,mainly in four aspects: the legislative concept is not adaptable,the legislative technology is not scientific enough,the legislative content system is not perfect,and the legislative characteristics Regional shortcomings,specific and in-depth explanation of the problem,analysis of the main reasons for its emergence.The third chapter puts forward some targeted countermeasures around the existing problems:at the level of legislative ideas,from policy to rule of law,from fragmentation to systemization,from principle to concrete,to achieve legal attent;at the legislative and technical level,the scientific and technological legislative procedures are standardized through the formulation of scientific legislative plans,the expansion of public participation,and the strengthening of post-legislative assessments;at the legislative content level,it is necessary to improve the four systems of local science and technology regulations,scientific and technological innovation management,scientific and technological legal responsibilities,and local characteristics legislation,and finally establish a scientific local science and technology legislative system.
