The content of human rights is expanding with the development of society, and the right to safe needs immediately being accepted by human rights system as an important one. The right to safe could make the security of person, the security of property and security of order intergrated, so the right to safe may gives a set of rights about security in existing laws, and finds the universal set for the subset to offset asymmetric factors between the reality and the names of human rights in China. At present the studies on the right to safe are mainly limited to parts, and more in blank. This paper, analyzing the interest relations and the orders of the right to safe by the game theory as a tool to prove the necessity of the right to safe establishing.Chapter one of the paper summarizes the background and the significance of studies of the right to safe, and introduces the main theories of the right to safe and the game theory. Chapter two provides the economic assumptions of the simulating market so we could study the right to safe using economic tools. Chapter three analyzes the interest relations in the angle of economics and the legal structure. The former gives the security right classification by concepts of economics, and the later by the legal structure. Chapter 4 by the game theory analyzes the interest relations of the right to safe to draw Nash equilibrium of the interest parties of the right to safe. Chapter 5 summarizes the full text and draws the conlusion that the establishment of the right to safe is the optimal strategy.Law analysis by economics is no longer strange, while the game theory is rarely used for law analysis. This may be concerned with the computational complexity and the dull theories of it. This paper tries the analysis of the right to safe by the game theory, and this try is the study of the "new" field of human rights, and it's also methodologically "new", so the author also has the final version hoping this paper could be a beneficial attempt.
