The foundation and security of the social stability and economic development is constructing harmonious labor relations. The current labor conflicts have become an influential factor in constructing harmonious labor relations. Collective bargaining system which has the trade union as one part is becoming an important way to dissolve the labor conflicts and construct harmonious labor relations. For its congenital political, class, the trade union in China will easily fall into a dilemma in the process of social and economic transformation. On one hand, the trade union plays the role in mainteining worker rights, on the other hand, it also act as a prospective government departments to maintain social stability obligations. Under these circumstances, as the socialism trade union with Chinese characteristics, the problem of how to deal with the relationship between the trade union and party and government departments, the problem of how to reasonable position itself and the problem of how to give full play to its role as "worker freewill organization"are arising more and more atterntion increasingly.This paper attempts to take collective bargaining system as the breakthrough point to discuss the way of trade unions' establishing harmonious labor relations. The thesis consists of seven parts.The preface introduces the reality, methods, structure and meaning of the research of the status. The first chapter presents the relevant concepts of constructing harmonious labor relations,also presents a review and summary the process of constructing harmonious labor relations.Then it discusses the current practice of main market economic countries between east and west, summarizing the characteristics of collective bargaining system in main market economy countries. Chapter Two is a case study of the trade unions' practice in Gucun Town which is in Baoshan District. Chapter Three analyses such the trade unions' problems as unclear positioning, the problem in organizing trade unions and the problem of insufficient subjective ability in negotiations. Chapter Four put forward reasonable suggestions and policy recommendations to the specific problems mentioned in Chapter Three with the help of the theory on socialist harmonious labor relations. Finally, the thesis makes a conclusion about the future problems, and puts forward some shortcomings.
