Market economy increasingly relies on the perfection of the credit system. However, currently China now faces a major problem of lack of credit With the globalization of economy and the development of market economy in China, credit is playing a more and more major role, not only it can promote the growth of national consumption demand but also optimize the structure of the assets of all kinds industries so as to support the growth of economy.However, Chinese economy has come from a long period which was dominated by planned economy and when credit industry was under no way of construction , the credit consciousness in this domain is far from being set up compeletetly. Except for some local regulations, no national laws related to the credit economy has been enacted, the credit agencies engaged in the business of credit in economic activities don't have any law to refer to, this situation lead to lots of breachment in economic transaction, the discreditable behavior has caused severe damage, not only the cost of transaction but also the whole national ecomnomy.Therefore, A comparative study of the actual conditions of our country with foreign legislation experiences on related aspects of personal credit,is of great significance to standardize and develop our credit industryThe dissertation consisits of four chapters, the main content is as follows:The first chapter describes the personal credit system, and the related concepts ,cites some points of view of some experts and scholars. this paper expounds the credit system and the economic development of internal relations.The second chapter, introduces in China about credit industry development and current situation of legislation, it puts forward some suggestions that China should accelerate national credit legislation of credit information partition,While breaking monopoly position, making the credit industry develop on a righttrack.The third chapter makes a analysis and study on three modes: governmental oriented mode, market oriented mode , and the mode of Japanese Bank, which adopts a membership mode. These three modes have their advantages and disadvantages respectively, For Current China ,this paper argues that governmental oriented mode meight be perferable.The fourth chapter discusses how to construct and perfect our personal credit legal system from the perspectives of credit model selection and supervision system, the legislative principles, resolving the conflict of public information and privacy issues .This article puts its focus on the credit mode, regulatory system and privacy protection in an effort to dicuss how to build and perfect Chinese national conditions of personal credit legal system. Holding that in the initial stagc, the governmental oriented mode can be adopted, when the conditions for the transition to a market-oriented mode mature, the National People's Congress shall formulate a national law,based on the integration of various resources, while reference should be made to the related foreign legislation schemes.
