The book of Anarchy State and Utopia which was published in 1974 and went to the heart of John Rawls' book, A Theory of Justice, has attracted vast attention. Especially, based on Robert Nozick's Entitlement Theory, he advocated that the justice of holdings should replace John Rawls' distributive justice. He pointed out that John Rawls' theory of distributive justice offended against the trend of historical development and it was patternized. On the Concept of Distributive Justice, In some cases, one should make sacrifices for the benefit of the most vulnerable people in society. So the violation of individual rights often occurred. On the contrary, Robert Nozick believed that justice of holdings conformed to the laws of historical development and it was not patternized .The legality of having wealth got supported by the principle of justice in acquisition, transfer and rectification. He fully respected individual rights and pointed that one can't encroach on the rights of others in any case.The thesis divides into 5 parts: I will analyze the background of age and theory , probe the theoretical basis of Entitlement Theory which was John Locke's theory of natural rights and Kant's moral argument that man is the ends and not just means, by the way of Study of thoughts history . They are the content of chapter one and two. The third chapter tries to reveal Entitlement Theory in its true colors based on the study of his arguments' starting-point, core, characters and worth aim ,by the way of study of hermeneutics. In chapter four, I offer a defense of the theory in various aspects by the way of dialectics. For example, the inviolable rights, the change from self-ownership to property ownership, the standards of Nozickian proviso, the problem of voluntary ,the dawn of the legality of property and so on . This chapter tries to give a new perspective of the inadequacies of the theory. In chapter five, I will probe into the significance of Nozick's Entitlement Theory on the areas of protecting individuals' rights and checking on government power and so on.There are several originalities: I think that Nozick explained reasons why the right of the individual is inviolable with the help of Kant's moral argument that man is the ends and not just means. According to Ronald Dworkin's Envy test I point out that the standards based on spirits and welfare are not reliable, directed against other people's criticism. After that, I stick up for Nozick from the reasons of the identification predicament and subject factors. At last, I use the method of Presumption of innocence when I explore the dawn of the legality of property.It can't be denied that a phenomenon or occurrence that individual rights and property are often infringed, and the government power is also not regulated correctly. So, I hope that Nozick's theory has some enlightenment to China.
