Employment, for it bears the weight of realizing people's personal dignity and own value, should be given primary importance among priorities by every goverment when they are making laws to protect the labor rights for the labors. Have the equal employment opportunity is the most important foundation for labors when they want to get the even treatment in the process of hunting jobs. The United Nation and the International Labor Organization have enacted some international conventions which endow each social member with the equal employment opportunity. It requires each contracting party to take appropriate steps on ensuring the legal rights that everyone has the free chance to choose and accept one job to make a living. Developed countries have enacted laws to define labors'the equal employment opportunity and enforced them nowdays. When we have a look at the situation in our country, employment discrimination problems were increasingly prominent to be accompanied by the further reforming and opening policy and the transformation of social economic structure, especially labors who didn't get the equal employment opportunity. Some employees were deprived of the equal opportunity to get a job mostly because the employing unit sets some harsh conditions that has nothing to do with the job to restrict the emplyees'equal opptunity. That's why this thesis focuses on the legal problem and make a study on how to gurantee the labors'equal employment opportunity through legislation. Through using the method of comparison ,this thesis studies the appearance of the equal employment opportunity concept. It also inspects the relative legislation and practice of the foreign country, analyses the existed imparity employment opportunity and why it arises. This paper indicates that to take examples by advanced experience of developed foreign countries and to establish a thorough legal system to protect labors'equal employment opportunity. The whole thesis is divided into four chapters, the details are as follows:Chapter one mainly defines the concept of equal employment opportunity, inspects the change and development of this idea, has a conclution on the value connotation of the equal employment opporyunity legal system.Chapter two demonstrates why there exists such disctimination phenomenons on labors'equal employment opportunity through the description of current situation of employment market in China.Chapter three introduces and comments on the legislation and practice of protecting labors'equal employment opportunity legal system in foreign coutries such as EU,USA,HK and international conventions of international laws. Summing up the advanced experience of these developed countries and districts, it will play a big part in completing the relative system in China.Chapter four puts forward some specific opinions and suggestions, towards establishing and perfecting our equal employment opportunity system, especially perfecting the legislation and the rescue method, through observing the legislation and practice of foreign countries.
