Employment is the people’s livelihood, civil rights groups, is the people to survive,social subsistence and development. Employment is a complex social and economicprocesses, and gender discrimination in employment is hindering the normal development ofthe employment market, make the female laborers in the employment competition in a verydisadvantageous position, endanger women workers with skills in pursuit of equal survivalrights. Along with our country economic system transformation and the adjustment ofindustrial structure, our country by traditional employment to competitive changes inemployment, labor employment in the process of gender discrimination problem becomesmore and more serious. Therefore, how to use legal means to eliminate gender discriminationin employment, gender equity employment has great theoretical and realistic significance.This article attempts from the legal angle of view to our country labor sex discrimination inemployment is analyzed, and put forward countermeasures, hope for China’s labor andemployment gender discrimination in solutionTo the problem of providing theory reference. The article from the legislation lawenforcement and judicial three angle, think should perfect our Country Prohibition of femaleemployment discrimination legislation, clear discrimination in employment standards,accelerate the formulation of law of anti employment discrimination, formulation of birthinsurance regulation, perfect the Employment Promotion Law of the relevant content. Theestablishment of specialized law enforcement agencies, increase women’s equality rights ofemployment protection, establish and improve the legal system, the establishment of specialanti-discrimination employment mechanism, clear discrimination of legal liability. Sounddiscrimination of female obtain employment in the way of judicial relief, the burden of proofsystem, allowing direct action to achieve relief, additional public interest litigation,strengthen women consciousness education, provide effective legal assistance.
