As a unique social culture, the origin of homosexuality has been a long time in China, dating back to ancient times of civilization. According to investigation of the scholars, there is also a hidden and a huge number of gay groups in contemporary chinese society, such as the professor Li Yinhe who is a researcher of chinese academy of social sciences speculates homosexuals have about 39 to 52 million in China under the authority of foreign investigation. However, homosexuality has been ignored and forgotten by mainstream culture in our society in a long time. Homosexuality has never their due social status and legal protection. Due to the exclusion and suppression of mainstream society and public opinion, homosexuals live in the gray area in long-term, resulting in disregard of their rights. When rights have been violated, the whole community disregard the rights of special social groups and remain silence, because of not willing opening their own identity, not daring to claim their rights and often enduring in silence.With the progress of modern civilization, as special group, homosexuality is gradually from hidden in the past to make public now, especially the spread of internet culture, the group hidden become "active" in the virtual world. Even brave homosexuality head out from the "underground":or open homosexual identity, or openly "get married" with his gay lover. Such as "PACO" and "Crystal" who are the first gay man in Guangdong were held an unusual wedding in a hotel in Zhongshan in January 9,2011. However, due to the taboos of traditional chinese culture and the existing law vague, the majority of homosexuals live in a serious state and their rights have been violated. Fundamental rights are not effectively protected. Based on the legal status of homosexuality and the rights of vulnerable groups, the study aims to raise awareness of the gay community's concern and understanding. I hope this article make some contribution in establishing the legal status and protecting the rights of homosexuals.
