At all times and in all countries, homosexuality has been with the human history, and with the development of human history, the survival condition of gays and lesbians also has experienced great and complex changes. Proud of same-sex behavior from ancient Greece, to the rise of Christianity, let gays face the plight of survival, and then to the development of the human rights movement and the gay community equal rights movement, the gay community’s aspirations for equality rights has aroused global attention. Look from the attitude toward homosexuality in the whole human society trend, you can feel people more and more tolerant attitude in recent decades. This attitude can be confirmed from the legislative attitude in western countries on longitudinal. More and more western countries actively exploring the possibility of protection of same-sex unions, and take different modes to protect the rights of the gay community. Since the1990s, the Netherlands, Belgium, Britain, the United States and other countries have legislation, combined with the different legislative pattern to recognize homosexuality and same-sex unions, safeguard the lawful rights and interests of same-sex unions. These legislative practice have a landmark to improve the legal status of gay, gay equality safeguarding rights and interests, to eliminate the social exclusion and discrimination against homosexuality. However, Gay this special group will still regularly by secular vision of discrimination in society, which makes their survival is still difficult, basic rights is difficult to secure.This paper mainly from the angle of legal culture on the gay community in western society changes and the protection of same-sex unions in Western countries, analysis the major obstacles of the protection of same-sex unions in Western societies—the conflict of Christianity and same-sex unions, analysis the reason of Christian strongly exclude same-sex unions and the trend of conflict, and the biggest driver of same-sex unions legislation—the doctrine of human rights support for same-sex unions. Comb through the legislation practice of western countries, parsing the profound reasons behind the western legislative practice to break the ice, seek legislation on same-sex beneficial experience can be used to overcome barriers of legal culture in our country, and promote the process of the protection of the rights of the gay community in China.
