The Study On The Pre-qin Confucian Political Idealism

Political justice is the core of political philosophy,has received the universalattention of thinkers from both China and other coutries.There was rich political justiceidea in Pre-qin Confucianism.This paper gives an explanation of "yi" which hasconcrete categories in legitimacy, justice and fairness as the core category of theConfucian idea of political justice and and other related categories.It is that "yi" as theindividual behavior criterion is promoter to political justice and social justice.This article disscusses two main contents of ideal justice and institutional justicein Pre-qin Confucianism. From the perspective of ideal justice,the assumptions abouthuman equality contained the idea that basic rights are equal and the opinion of"electing the wise and able" and doing good to vulnerable groups reflected the idea for"Things for all people" in Pre-qin Confucianism;from the pespective of institutionaljustice, the Pre-qin Confucianists stood for Confucian doctrine with the premise of"identifying status" and the purpose of promoting "he".These two aspects wereindispensable and constituted the main contents of Pre-qin Confucian idea of politicaljustice jointly.There is concrete analysis about the realizing route of the Confucian idea ofpolitical justice.There were three specific ways to pursuit the political justice inConfucianism:firstly,"For politics path,should be in rectifying names","rectifyingnames" as a sympol of political identiry and status meaned rectifying names orstatuses;secondly, the confucianists consisted that the political practice should combineConfucian doctrine and government by law;thirdly,the confucianists insisted thatrespecting and employing the talents should be the policy on the selection of politicalofficials as well as the distribution of politcal power.The evaluation of Confucian political justice idea is an important part in thispaper.The Pre-qin Confucian political justice idea played a positive role in China'sfeudal political life;however, it should not be ignored that the Pre-qin Confucianpolitical justice had historical limitations that payed much attention to identity justice with emphasizing level principle and thought highly of moral restraint.The rational content in Confucian political justice idea still has positivesignificance in contemporary era.For example, the complementary thought of flexiblemoral and legal system,the combining idea between individual justice and "the wholeworld as a community",they all deserve our research and creative transformation.Thereis a significant value in building our harmonious socialist society by learning thePre-qin Confucian political justice idea and promoting the developing ofcomplementary political justice.
