With the rapid development of China's mobile communication, mobile phone has become the "fifth media" after newspapers, radio, TV, the Internet, and plays a more and more important role. With the popularity of cell phone use, people enjoy a modern communication means which is quick and convenient. At the same time, SMS business developed rapidly, more and more spam messages appeared. There are lots of SMS spam which contain advertising and fraud. Mobile phone users'interests are violated seriously. The number of those messages has been increasing, has severely affect people's daily life and public communication environment. Most of those received "the uninvited" messages are advertising messages. This article contains analysis of the infraction of advertising messages through learning the characteristics and development trend of advertising messages. This paper analyzes tort liability by summarizing the subject and object of infringing. And through analysis the reference of foreign researches about advertising messages, combining with the regulation of China, summarize suggestions on managing advertising messages. The suggestions are:establishing peace right and formulate special message service regulations, formulate personal information protection to strengthen the protection of personal information to prevent cell phone user information collected by illegal trading, strengthening technical management and self-discipline, establish administrative supervision mechanism perfection advertising messages access and supervision system and so on.
