Study On Compliance Mechanism Of Climate Change Treaties

As a typical global problem, climate change problem can not change the fact of climate change. We think that mitigate the harm of climate change is clearly a pure global public problem. The benefits of mitigating greenhouse gas emissions are non-competitive and non-exclusive. The countries join the climate change treaty to their country foreign policy. They consider different country interests not only pay attention to the obligations of climate change treaty.Climate change treaty compliance mechanism goes through three stages:the idea of climate change treaty infancy stage, stage of development practice, stage of revising and improving. Compliance mechanism of climate change treaties is composed by three components, the primary rules system, the compliance information system and the non-compliance response system. These three elements together support and maintain close coordination with the Treaty of the normal operation of the compliance mechanism. We should see that the compliance mechanism of climate change has played an invaluable role in improving the operation of climate change, urging energy conservation, strengthening the overall national climate system, self-improvement, and the promotion of international cooperation. However, the current compliance climate change negotiations involved some of the focus:compliance objectives and principles are faced challenges; rules of climate change treaty provision are ambiguous; the diversity of interest and ability in the compliance process; climate change treaty are soft law. A series of problems caused by climate change treaty hinder compliance mechanism negotiations process. In order to overcome these problems to the entire international community caused by the resistance to compliance, the 2012 post-Kyoto climate change treaty compliance mechanism should take action:compliance process should adhere to the principle of fair and balanced priorities, which is climate change treaty negotiations should always adhere to the principle of climate change treaty; improve the transparency of the compliance mechanism; establish effective mechanisms for financial and technical assistance to aid effective operation of the compliance mechanism. In addition, soft constraints for the climate change treaty compliance path, post-Kyoto climate change compliance mechanism should use the experience of WTO for reference and bring the enforcement mechanism into the compliance mechanism.
