On The Improvement Of Our Criminal Investigation Procedures

The investigation procedure is very important in the entire criminal proceedings,which is the basis and prerequisite for criminal proceedings,and directly affects the final quality and result of criminal proceedings.This article researching the nature,content and status of investigation procedure , analyzes the characteristics and development trend of the Criminal Investigation Procedure in the Countries with different legal systems of the world.The article deeply discusses the problems and deficiencies in the highly centralized investigation power,the lack of neutral judicial review,the relatively underdeveloped the protection mechanism of the criminal suspects's procedural rights,and the violated legitimate rights of criminal suspects during Chinese criminal Investigation Procedure,which is from the three stages of investigation procedure in stating,Implementation,ending.The author proposes six views to modify and improve our criminal investigation procedures in establishing construction litigation of the investigation procedure,protecting healthy operation of the investigation power,protecting the rights of criminal suspects,improving the rights of defense counsel,improving the collection of evidence and measures of seizing criminal suspects,Improving the relevant provisions of the end of investigation.
