Criminal Law Protection Of Intellectual Property Trade

With the continuous development of economic globalization, the protecting system for trade of intellectual property rights gradually changes from domestic protection to international protection, the existing civil protection and administrative protection could no longer fulfill the requirement of trade of intellectual property development. Protection mode of trade of intellectual property presents a trend of high standardized, and this will impel the criminal protection to get into the field of trade of intellectual property rights slowly. In recent years, the criminal protection consciousness of the trade of intellectual property has improved obviously. So far, China has built a thorough criminal protection system of the trade of intellectual property based on the requirement of WTO. But compared to TRIPS, there are still some problems existing in the lawmaking and enforcement link of intellectual property, and these will cause series of disputes in the process of international intellectual property trades. This article starts with introducing the related concepts and protection targets of trade of intellectual property rights, analyses the reason of why criminal law interposes into trade of intellectual property rights, next teases the current situation of criminal protection for trade of intellectual property rights by the WTO, and then proposes some advisements on this point, expecting to contribute to the criminal protection system for trade of intellectual property rights of our country.
