| The right to housing is an item of fundamental human rights which manifests the responsibility of State and Government. However, because of the improper fulfillment of the national obligation of housing security, the right to housing of the urban residents of our country, especially the middle and low-income stratum, is not well-protected. Based on the purpose of perfecting our country's urban housing security legal system, promoting the full realization of the right to basic housing of our country's urban residents and gradually realizing the aim of establishing a higher level of housing security system, the author chose this subject.The main content of this paper is as follows:Chapter I instructed several items which should be previously listed, including the definition of research object, several relative issues, research significance and innovative viewpoints of this paper. Chapter II and III separately introduced the basic theory of human rights and the right to housing and discussed the relationship between the two concepts. Besides, the author pointed out the main housing problem and the way our country should take by nowadays and stated the realizing standard of right to housing of our country's citizens in current under the premise of clear dissertation of the national obligation of housing security. Chapter IV indicated the defects of legal system of protection of the right to basic housing of our country's residents nowadays, including the coverage of housing security, the system of legal norms, the low-rent housing system, the economical-and-suitable housing system, the new-type housing security system, the financial system and the management system. Chapter V summarized the housing security policies and legislative experience of Singapore and Hong Kong Special Administrative Region of China according to the comparative research of the aforementioned two districts. Chapter VI put forward the perfecting organism of the legal protection of the right to basic housing of our country's urban residents from three aspects:organization, legislation and judicature. Finally, Chapter VII briefly summarized this paper and advanced some expectation.The author thought that, to research the legal protection of the right to basic housing of our country's urban residents from the perspect of human rights, by its very nature, was a calling for the national obligation of housing security and an active pursue of the return of the government responsibility. |
