A Study On Legal Issues Of Housing Security Of Citizens

Selecting housing security perspective as a thesis topic and research, which from the commercialization of housing prices and the status quo of China’s continued high rate of a little thinking. Although this from the perspective of the basic theory of constitutional and administrative law perspective somewhat off track, with further thought and study, I found that housing is not just a man’s shelter, it is also human dignity and a characterization of social justice. In recent years, housing prices in many cities have been far beyond the capacity of ordinary citizens. Some people unable to meet their basic housing needs through the market, and to some extent, it led to many social problems. Housing problems are human rights issues and the right to housing is basic human rights of citizens. For such a country for human rights in developing countries, depth study on housing security has a certain meaning and value.The article consists of five parts:The introduction section introduces the research background, significance and research methods.In the theoretical part of the basic housing security of citizens, I describe the right to housing is a basic human right enjoyed by citizens, and some countries have been a requirement for the right to housing at the legislative level directly or indirectly. And then, I explore that it is the country’s obligations and the responsibility of the Government to realize the housing rights of citizens. The purpose of the requirements of the national existence of the State has the responsibility to make the greatest efforts to protect human rights. The obligation of the State to protect the right to housing is a basic right of citizens to housing. And as a performer and direct manager of social policy, the role and functions of the government requires that it has to take the responsibility to make the social justice achieved.After analysis the basic theories of citizens housing security, I discuss the current situation of China’s housing security problems, it includes the lack of legislation, specialized agencies, judicial relief and housing security of graduates, and also inadequate supervision. And then I discuss the perfect housing security of our citizens, and to solve the housing difficulties of necessity at the right time.The fourth part describes the experience of some of the extra-territorial aspects of housing security of citizens. They developed a variety of housing security systems according to their actual situation, which plays a positive role in promoting the realization of housing rights of its citizens, such as the relatively perfect system of Britain and America, specialized agencies of Singapore and Hong Kong and the French judicial protection mechanism. They all take certain significance for the protection of our citizens’right to housing and to solve the problem on housing security.Finally, regarding our main problems on housing security, I discuss the legal path to improve housing security of our citizens in order to realize the housing rights of citizens.
