With the deepening process of industrialization, the global ecological environment is also experiencing unprecedented challenges. Many foreign countries have begun to promote "green revolution." In the field of international trade, countries adopt green technical measures by improving the environmental standards to regulate international trade, so as to protect human health or safety, animal and plant life or health and the environment. Both from the environmental point of view - brought the pollution based on import trade, the domestic market or the lack of regulations and standards, or from the political and economic point of view, to perfect the legal system of green trade protection is the practical requirements. Conform to international and domestic developments, this paper will do analysis on the aspects of the sustainable development theory and the legal basis of the green trade protection, targeted Learn from the EU, the United States, Japan and other countries which have more complete green trade protection system, to explore the legal system of green trade protection suit for our country. This paper will first establish the guiding principles in the green trade protection, including the principle of necessity, the principle of transparency, the principle of non-discrimination and national treatment principles, the principle of international, the principle of special treatment for developing countries. Secondly, the paper will seek the Chinese regulations and technical standards and other institutional system in the green trade protection, and gradually strengthen the guidance of national green consumption and raise the level of the domestic detection technology.
