Legal Research On The Intellectual Property Protection Of College Students' Technological Innovation

With the world's scientific and technological progress and rapid development of economic globalization, intellectual property protection system has become the basic legal system and policy instruments and it plays an important role in enhancing the international competitiveness and revitalizing the economy.Meanwhile, the national university plays an essential role in the national science and technology innovation system.The technological innovation of college students,as a fundamental part of technological innovation, its intellectual property should be reasonabley protected. In this article,the author begins from the the form, content and development of technological innovation,and then interprets the role of science and technology innovation in the intellectual property system,and analyzes major problems in the intellectual property protection system. At last it researches the legal issues of the intellectual property protection system in technological innovation.The intellectual property system has provided a fair environment, promoted technological innovation and will play a positive role in college students technological innovation,but because technological innovation activities in China start lately, in practice we lack conservation awareness and the intellectual property system is imperfect, all of these hinder the intellectual property protection.to the research of college students'technological innovation.So the author suggests we should implement the educational objectives of intellectual property rights in twelveth Five-Year Plan strengthen the system of university intellectual education and integrate it into the educational system in line with the principle of balance of interests; we should establish the professional department to protect the intellectual property of college students;We should improve the intellectual property ownership and pefect the system of distribution of benefits incentives on the principle of encouraging innovation and the principle of balance of interests. Then we try to establish and improve China's intellectual property laws and regulations and make technological innovation activities of college students have a sustainable and healthy development.
