Violations Of The Behavior Of The Network Virtual Property Criminal Regulation

The formation of virtual property results from the development of cyber technology, especially the rapid growth of the online game industry. But at present, the current criminal law of our country doesn't clearly define the virtual property and those infringements of it.. As a result , there is not a unified standard to follow in judicial practice, which is in urgent need of the regulation of criminal law. In this article, it is proved that it is legitimate to bring virtual property into the protection of criminal law from the perspective of the formation, attibutes and ways of obtaining of virtual property. And the conclusion that the protection of virtual property should integrate all efforts is drawn on the basis of the analysis of the diversity and complicated development tendency of infringements together with the examination of the legislation status of all countries. Finally, some advice and proposals are put forward for improving the criminal regulation of the infringements of virtual property by discussing propriety of criminal regulation, the choice of legislative mode and the difficult problems in practice.
