Car rental industry constitutes an indispensable part of modern transportation service sector. The development of car rental industry is of great significance to boost the automobile industry, satisfy people's needs of production and daily life activities, improve the management structure of road system, alleviate the pressure of urban public traffic and taxi transport, and promote energy efficiency as well as environmental protection. Yet currently, car rental industry in China still remains in the rudimentary stage, which is manifested in such problems as the comparatively small concern scale, extensive operation, nonstandard and inconvenient services. Additionally, a unified and orderly market throughout the country needs to be established. Thus it is pressing to guide and cultivate the car rental market, standardize the proceeding of rental, and accelerate the development of car rental industry. Current research achievements mostly concentrate on car rental service items, enterprise management mode, as well as the development orientation. However, few researchers has probed into the car rental industry in the view of legislation, let alone laying a framework for the relevant laws and regulations, and analyzing and solving problems this industry is faced with from the perspective of rights and obligations of the parties concerned. The author attempts to make a systematic research into the legislation of car rental in China, proposing that the government should formulate unified and standardized regulations for the car rental industry and form a unified understanding on car rental. The author also expatiates on his viewpoints regarding the legislation level of car rental industry, positioning of car rental industry, its relevant conceptions, the range of adjustment, principles of management and development, its access system, management specifications, and main management regulations, etc.This thesis consists of three parts, namely, the introduction, the body and the conclusion.In the introduction part, the author mainly discusses the development background of car rental industry, and elaborates on the reasons of topic selection, as well as the background, purpose and approaches of his writing.In the first section of the body part, through the systematic introduction of the conceptions relating to the car rental as well as the evolution of relevant policy making, the author summarizes the development history and background of the policies concerning car rental industry in China in each stage characterized by ambiguity and repetitiveness. This lays a foundation for the elaborate analysis in the following paragraphs.In the second section, the author summarizes the development and management problems in practice of China's car rental industry.In the third section, the author points out the existing defects of China's car rental industry in view of the law practice of the policies and regulations concerning car rental by summarizing and analyzing the problems in its development and management practice. The author introduces the relevant countries and regions car rental industry successful legislative experience and management system.In the fourth part, the author elaborated the national car rental industry the necessity and feasibility of legislation and raises his proposition of the perfection of legislation, including the selection of legislative level, identification of its attributes, the range of adjustment, design of industry access system, and construction of management system etc.In the conclusion part, the author declares his attitude toward the legislation of car rental-The government legislature should push forward the legislation process for the car rental industry on the basis of China's practical situation of this sector, and take advantage of domestic and overseas advanced experience, thus laying a solid regulatory foundation for the development of car rental industry.
