Housing has always been one of the most basic elements of people define a happy life,has also been a major problem that plagued hundreds of millions of people. In recent years,the livelihood problems of the printing of a hot topic, Premier Wen proposed to develop theeconomy and improve people’s livelihood is the bounden duty of the government, and thusfocus on the construction of affordable housing reflects the Government’s welfare of thepeople much national attention. Central residential housing security building efforts continueto increase at the same time, the increasingly prominent urban housing problem of the"sandwich class", and re-combing the integration of existing housing security system, publicrental housing and finally the long-awaited.Since the public rental housing in2009the first time was officially put on the affordablehousing construction schedule by the Department of housing construction, just three yearstime building public rental construction seems to spark spread across the country to lightnumerous sandwich layer "Housing Dream", but at the same time repeatedly experience thefrustration warned people, establish and perfect the imminent legal system of publicrental. Paper from the legislative point of public rental system, a more comprehensiveresearch, analysis and reflection on the status of current legislation, identify problems anddraw on the experience of public housing construction in some developed countries andregions, with the national situation from the legislative point of view explore public rentalconcept, Establishment of the Rule, which expect to contribute to regulating and promotingthe construction of public rental system.This article is about30000words, divided into four parts, in addition to the introductionand conclusion.The first part, the public rental-the inevitable choice to resolve the plight of peoplehousing. That part from the concept of public rental, nature and necessity of existence and topass legislation to establish public rental system to analyze the necessity and importance ofthe understanding of the system of public rental and public rental legislation.The second part, the status and problems of public rental legislation. The overallsituation of the public rental legislation is a central legislation becomes vacant, the locallegislative level is low and uneven, and the legislation as follows:(a) legislative effect: the low level of legislative effect (b) the legislative process: the legislative process publicparticipation in the full (c) specification: the nature of the public rental there is a dispute;government funding sources of public rental security responsibilities are not clear; accessconditions set less reasonable; liability and supervision mechanism is not perfect; disputeresolution pathway missing. What lead to the above legislation it can be summarized asfollows:(a) public rental legislation lags behind the impetus to the development of publicrental legislation (b) lack of unity (c) development of local public rental underpowered.The third part, the construction of public rental system extraterritorial experience andrevelation. The articles selected for a number of public housing construction typical ofcountries and regions, and take specific system summarized the successful experience ofcountries in a more detailed summary of elaborate, noting that its implications for China.The fourth part, the concepts and rules to build public rental system. Take ErnstForsthoff ’s survival care concept as the basic idea of the construction of public rental system,it can be useful to accurate positioning of the legal system conducive to the public rental, aclear government role and functions of play, the construction of public rental to explore a newmodel of innovation and construction of public rental.
