On The Strengthening And Innovation Of Local People's Congress's Power Of Supervision On Environment

The strengthening of the effect of"People's Congress"in political practice in China ,illustrates that the design and the construction of political system in China have made great progress. In form, the position of local People's Congress ----the highest local authority---- stems from the direct provision of the Constitution. In essence, its power comes from the autonomy of citizens in the local area. The emerge of environmental problems has certain inevitability, mainly because currently the local government that is eager to excessively develop local economy and show the local political performance lopsidedly chases the economical development to increase local productivity. Nowadays the environmental problems that increasingly appear obviously not only slow down the speed of the economical development but also hamper the normal survival interests of the citizens, therefore, now in order to urgently require the local People's Congress ,who is on behalf of local public, to effectively supervise the environmental administrative legislations,environmental administrative law enforcement and the environmental judicial acts of local courts and local Procuratorate starting from protecting local people's present and future interest with the purpose to actually and effectively protect local environment ,it needs to start the power operating mechanism of the local People's Congress. The local People's Congress has power and ability to supervise the local"Government,Court and Procuratorate"to resolve the environmental problems. However, the key is how to supervise legally,scientifically and effectively, and this is the difficulty placed in the front of the local People's Congress. The paper tries to preliminarily explore the problem from five aspects: The basis of the legitimacy of local People's Congress's power of supervision on environment; The disadvantages of local People's Congress environment supervision mechanism and its originals; How to enhance,implement and innovate the environment supervision system of local People's Congress; To enhance the supervision on the environmental administrative acts of local governments; To start the environmental judicial supervision on the local"Court and Procuratorate", and the purpose is to further strengthen,implement the reasonable existing systems, meanwhile, the paper tries to design the new systems to improve local People's Congress's power of supervision on Environment.
