Research On The Legal Matter Of Consumer Rights And Interests Protection In The Field Of Food Security

With China's rapid economic development and technological advances, a series of food problems appear, such as, melamine milk, clenbuterol ham. From the food security incidents, we can find the current legal system is not able to effectively regulate and correct food security, China's food security situation is still grim, and there is still more work to do. In order to meet the development needs, we should concentrate on the management, regulatory, institutional and research, monitoring and other aspects. It is of great theoretical and practical value to study on the ways to protect both the normal, healthy and orderly development of the enterprise, but also the full, timely and complete compensation for the consumers'interests.Based on the above viewpoint, the author intends to analyze the consumers'protection in the field of food security from the incidents and characteristics of the food security. With the analysis of the performance, reason, system and also some suggestions to similar foreign things, the paper intends to give some suggestions to the improvement of the protection of consumers'interests in the food security filed. The structure of this paper is as follows:The first part quotes some national food security cases and this leads to the main thrust of the article, that is, how to get maximum protection to the consumers'interests.The second part is about the characteristics of consumers in food security presentation and the main reasons and features of the violation of the consumers'interests.The third part inspects the field of food security consumer protection laws and the status of inspection practices, including the country's laws and regulations on food security in the field of consumer protection provisions and the legal practice in the field of food security.The fourth part discusses the foreign food safety consumer protection legal experience and inspiration of the discussion, specific reference to Europe, America, Japan and other foreign food safety consumer protection legal experience and inspiration.The fifth part is the focus of this article. It is about the suggestions to the improvement of China's laws and policies in the field of consumers'protection, including the provisions of improving the consumer's right to know the protection in Food Safety Law, the ways to improve the food safety supervision mechanism, the ways to improve the problem of food recall system, the ways to establish food safety public welfare fund compulsory insurance, the ways to draw lessons from the standards of developed areas and the ways to improve public interest litigation mechanism for infringement of food security .
