Food security is at least in people’s daily life, food can not guarantee security,people’s health will be a serious threat, the society will not showing a harmoniousscene expected. Now with the rapid development of economy, the field of food alsoappeared in the development picture agrees with the society, food safety and thecorresponding development has encountered challenges associated with the society,has become a concern for the public, in this context, and food safety is related to theinterests of consumers of legal problems will come one after another, we need tocarry on systematic research to the food safety, combined with the practice of thetheory advanced foreign experience and consumption in China, and find out forconsumer rights and interests protection system itself, the integrated use of civil,criminal, administrative and other legal means to protect the legitimate rights andinterests of consumers.Based on this background, the author based on the situation of food safety andsocial foundation of existing in this field and the protection of consumer rights and interests of the legal problems in practice and the pros and cons of this research,combined with China’s judicial practice in the field of food safety, protection ofconsumer rights and interests, in foreign practice experience and Chineseconsumption under the current situation, not only including some in the legislativesystem of perfect, also need to strengthen the government to use administrativemeans and the public on food safety awareness, to the legal and social regulation onfood safety for tighter regulation of food safety problems, make more social publicinterests, and promoting social harmony.In this essay, by using the method of comparative analysis, as a study on theproblems of food safety areas of consumer protection, this paper intends to fromdomestic and foreign case analysis, through the analysis of its shortcomings anddiscrimination, and then put forward countermeasures to improve some, also use theempirical analysis method, through the analysis of some typical cases and judicialpractice. Some achievements, from the current legal issues as the protection ofconsumer rights, plus some inductive analysis, through practice, analyses them, and puts forward some experience, status, problems, and finally put forwardcorresponding countermeasures.This article described some of the events in the field of food safety law case,thus raises the question of the protection of consumer interests, and the true purposeof consumer protection this thesis topic and to achieve their own interests, throughthe summary of the field of food safety consumer protection, basic theory and foodsafety field leads to protect the rights and interests of consumers. Infringement andrelated analysis, the more important combined on the basis of judicial practice, wroteabout the performance issues of food safety consumer protection, furtherperformance of food safety in the field of consumption in China the seriousness andurgency.This paper analyzes the economic status of China’s food safety law ofprotection of consumers’ rights and interests, namely food safety consumerprotection laws and regulations reflect current economic and food safety consumerrights and interests protection of economic problems in the law, and on thecombination of legal theory and practice, the formulation of certain laws and regulations in the legislation, reflect it is not the effect and the expected goal, need isthe combination of theory and practice, can play the effect, also analyzes the legalpractice of foreign food safety consumer protection, is mainly with some foreigncases and practice, combined with food safety, China are compared, and then sum up,write the foreign in the legal practice of enlightenment for us to use. In view of theseproblems, the problems of food safety to improve consumer protection system,which is about the perfection of relevant laws and regulations and actual legislation,law enforcement, and judicial binding and effectiveness, and learn from foreignadvanced experience and advanced food standards, and the public interest litigationsystem.Seeing that the present status of research, domestic research has not yielded theexpected effect, need to be more systematically, including in some of the legalsystem, while in foreign research on food safety relatively early, will be more perfect,such as the establishment of the United States of America the law system isrelatively early, formed the federal legislation and state legislation combined withlegal means, comprehensive use of civil, criminal, administrative, to protect the legitimate rights and interests of consumers. Therefore, I hope this paper can provideuseful suggestion for the interests of consumers of legal problems of food safety inchina.
