Gene technology, a heatedly discussed issue ever since its birth, has brought opportunities to many fields, and among them, medicine and pharmaceutical industry, agriculture, resources and chemical industry are especially indebted to it for the new branches it created for them. In the early 90s, gene technology began to get commercialized, and in agriculture and medical and pharmaceutical industry, it experienced an even more rapid improvement and marketization. In the 21 st century, gene technology has become a pillar technology which may affect the national economy as well as people's livelihood.Genetically engineered food is the first genetic product to enter people's daily life it is also the hopeful solution to the worldwide food shortage. However, the dispute on the safety of genetically engineered food has never been settled, so there must be legal solutions to the potential risks. This essay will discuss legal problems related to genetically engineered food from the viewpoint of economic and administrative law. This essay is divided into three parts. The first part briefly defines genetically engineered food and introduces the disputes on its safety, and analyzes the necessity of legal backup, i.e., consumers'right to know and environmental rights. The second part summarizes the situation of legislation related to genetically engineered food in China and points out its defects by means of analysis. The third part, comparing genetically engineered food legislation in the States and the European Union and considering the current legislative situation in China, proposes that China should adopt a compromised legislation pattern and offers detailed suggestions such as improving labeling system and establishing food recall system.
