The Civil Protection Of The Privacy Right Under Internet Environment

With rapid development of internet industry and e-commerce, internet becomes an indispensable part in our social lives. We depend more and more on internet in our daily lives, not only in learning and working, but also entertainment activities. While we enjoy the convenience provided by internet, our personal data and activities are also exposed on internet which causes many privacy infringement events under internet environment. So it is an urgent task for us to protect privacy rights under internet environment.Privacy right has become an independent legal civil right as the Tort Law of the People's Republic of China was adopted and came into force. Following this, the protection and remedy of privacy right under internet environment is in the spotlight. Because of the short time of protection on privacy right as an independent right, the rules on this topic are not specific and scattered in many normative documents. As lacking a set of developed theory, legislation and enforcement system, the right owner would be difficult to get his remedy when his privacy right under internet environment has been infringed.The dissertation consists of three parts besides introduction and conclusion. Part one is basic introduction of privacy right under internet environment. It analysis the basic characteristics of privacy right, defines the concept of privacy right under internet environment. Then, it analysis the basic characteristics of privacy right infringement under internet environment and expounds the significance of privacy right protection under internet environment. Part two is research on legislation and jurisdiction situation on privacy right under internet environment in China. Through studying the legislation and jurisdiction situation on privacy right under internet environment before the enforcement of the Tort Law of the People's Republic of China and analyzing the rules of the Tort Law of the People's Republic of China and the problems existing in China on this field, we conclude that it is urgent for China to perfect the legal rules on the point of the specification of privacy right under internet environment.Part three is legal suggestion of perfection on the legislation of privacy right under internet environment. Firstly, it analysis the basic ideas on the protection of privacy right under internet environment. After expatiating the guideline and basic principles on the protection of privacy right under internet environment, it suggests that multi-layered legal protection system should be adopted to reach the objective.
