The entry & exit administration is a kind of legal system which the international society extensively implement, and through which all countries manifest their national sovereignty, and safeguard the national security and benefit. The current administration on exit and entry in China is the exercise of jurisdiction, through which, the country administer the entry & exit of Chinese citizens and aliens and related matters,the entry & exit authorities regulate and control the activities of entry & exit,and also is one part of the national jurisdiction with the foreigners,and it is very important to safeguard its state sovereignty, security and benefit, improve the communication in political, economic and cultural between China and the other countries.The current law on entry & exit administration mainly formed in the 1980s to the 1990s, which was a clear imprint of the planned economy era. At the beginning of the Reform & Opening up, Immigration of people, The legal system on exit & entry play a proper role, for visitors flowrate and freight volume were less. With the economy booming,however, visitors flowrate and freight volume get a rapid growth, awareness of rights of the passengers become stronger and stronger, the demand for level of law enforcement and services at ports is increasingly high. It is those factors that make the conflict of laws and loopholes of the current immigration law obvious. It is necessary for the legal system to change and improve now.From the perspective of law enforcement, the author discusses the basic legal concepts, and analyze the defects of the current legal system combined with the the relevant theories on the legal system to find the the better countermeasures.
