The Protection Of The Legitimate Rights And Interests Of Returned Overseas Chinese In Fujian Province

China is marked with its multitudinous overseas compatriots, who and numerous returned overseas Chinese constantly have the glorious tradition of loving motherland and hometown. They have made great contribution to the national democratic revolution and socialist revolution and development, especially the Reform and Openness of China, as well as the socialist modernization. This is our main national characteristic and dominance. Overseas Chinese, the dominant feature of Fujian province, consistently makes great contribution and becomes potentials to Fujian. Great achievement of reform and opening up in Fujian during 30 years largely benefits from the full play of overseas Chinese.Currently in China, laws and regulations on overseas Chinese, are scattered throughout the law , administrative and local rules and department rules, except"LAW OF THE PEOPLE'S REPUBLIC OF CHINA ON THE PROTECTION OF THE RIGHTS AND INTERESTS OF RETURNED OVERSEAS CHINESE AND THE FAMILY MEMBERS OF OVERSEAS CHINESE". Many of them have problems of lag, low operation and even hard to fulfill. The deficiency of law will lead to the inefficient protection of overseas Chinese and their inland lawful rights and interests. In new period, we must further improve our work related to overseas Chinese affairs and bring the overseas-Chinese-related laws to completion. Only when the inland lawful rights and interests of overseas Chinese and returned overseas are effectively protected, can we further cohere their patriotic mind, can we give full play to their potentials, can we inspire the enthusiasm and initiative of broad masses of overseas Chinese to speed up the peaceful reunification of motherland, as well as to construct HaiXi(the economic region on west side of taiwan straits). For that reason, studying the situation of protecting lawful rights and interests of overseas Chinese in Fujian and making proposals for consummating the related laws and regulations is particularly necessary.This essay is divided into four parts, studying the situation of protecting lawful rights and interests of overseas Chinese and returned overseas in Fujian and making some proposals for how to perfect laws and regulations related to them. The documentation method, research method and method of comparison are mainly adopted here in this thesis. By collecting, studying and sorting out the documents from the current documents, the writer systematically defines the overseas Chinese and returned Chinese,and summarize the situation of the overseas Chinese and returned Chinese in Fujian, as well as current social background of the work related to overseas Chinese. The writer also systematically collects the real status reflecting the work related to protecting the lawful rights and interests of returned overseas and overseas Chinese. What's more, the writer analyses the overseas Chinese affairs and livelihood situation in Fujian and the working situation of departments in charge of overseas Chinese and returned Chinese in safeguarding lawful rights and interests of them.Through comparison method, the writer makes vertical and horizontal comparison.among the laws and regulations related to protecting overseas Chinese and returned Chinese at different levels. With the methods above, the writer further analyzes the problems existing in protecting lawful rights and interests of overseas Chinese and returned Chinese, thus puts forward some ideas and advice on consummating the related laws and regulations.In Chapter One, the writer states the legal concepts of returned overseas and overseas Chinese and introduces the situation and features of returned overseas and overseas Chinese in Fujian. In Chapter Two, the writer analyzes the situation of protecting lawful rights and interests of overseas Chinese and returned Chinese, then points out the problems and analyzes the reasons. In Chapter Three, the writer researches the situation of protecting lawful rights and interests of overseas Chinese and returned Chinese and studies its impacts. Furthermore, the writer also compares the characteristics of safeguarding lawful rights and interests of overseas Chinese and returned overseas in Fujian. Finally, the writer puts forward some suggestions on how to complete lawful rights and interests of and returned overseas and overseas Chinese.
