Study On Legitimate Rights And Interests Protection Of Overseas Chinese, Returned Overseas Chinese And Their Relatives In Shandong Province

Overseas Chinese, Chinese of foreign nationality and returned overseas Chinese and of the family members of Chinese nationals residing abroad is a special group formed historically, which plays an important role in all-around development of Shandong province. Effective protection of their legitimate rights and interests in accordance with the law will contribute to fully display their unique advantages and further arouse their imitativeness and creativeness. Shandong province has all along attached great importance to protection of their rights and interests and the situation here is good. However , there are a great many problems crying out for solutions exists, such as lacking of understanding the importance of protection, incompletion and unadoptation of regulations and policies, system and mechanism, inadequate supervision and enforcement and so on, which impairs their legitimate rights and interests in Shandong and influences the healthy and sustainable development of Shandong provincial overseas Chinese affairs career.The layout of the thesis is as follows. Chapter 1 firstly introduces the connotations of overseas Chinese, returned overseas Chinese and of the family members of Chinese nationals residing abroad, and then followed by the fundamental distinction among them. Secondly, the thesis talks about the main principles and contents of rights and interests protection. The main principles of rights and interests protection generalize as equality and specialty. The content of rights and interests of the family members of returned overseas Chinese includes politics, economics and property, social security, labor employment, donation, border crossing, abroad and judicial relief. The content of rights and interests of overseas Chinese divides into rights and obligations. Moreover, the thesis gives more emphasis on the protection of overseas Chinese' rights and interests in Shandong province.Chapter 2 investigates the situation of rights and interests protection of Overseas Chinese, returned overseas Chinese and of the family members of Chinese nationals residing abroad in Shandong province. First, duties on overseas Chinese affairs of related political organizations in Shandong province were introduced and then followed by a comprehensive and systematic elaboration on overseas Chinese affairs organization in Shandong province from longitudinal and lateral angle of aspects. Second, national laws and regulations was introduced and then followed by current policies in Shandong province.Chapter 3 discusses three shortcomings in protection of the rights and interests of overseas Chinese and of the family members of Chinese nationals residing abroad. These shortcomings are as below: lagging of law of the protection of the rights and interests; absence of the policy of the rights and interests; ineffective execution and supervision of propaganda of the law of overseas Chinese affairs.Chapter 4 emphasizes reason analysis of insufficient protection of rights and interests. The main reasons are as follows: insufficient understanding of the status of overseas Chinese affaires, incomplete master of the situation of overseas Chinese, lagging of theoretical research, limited resources of overseas Chinese in Shandong and unbalanced development of different cities in Shandong province, unscientific mechanism and system concerning protecting law, cadres who are unaccommodated to the work.Chapter 5 gives suggestions concerning protection the rights and interests of overseas Chinese. The main suggestions includes: more emphasis will be put on the protection of rights and interests, change traditional thinking and work mode effectively; the enhancement of the making of laws and regulations concerning protection rights and interests, getting a right understanding of principles, expanding of all-round fields, focusing on key points, integrating resources from different aspects; efforts should be made to propaganda law concerning overseas Chinese affairs, getting a clear understanding of duties of five government organizations concerning overseas Chinese affaires, making an effort to construct a good atmosphere of rights and interests protection; enhancing the execution and supervision. The rights and interests of overseas Chinese in Shandong province will be protected and the imitativeness will be aroused through above measures in order to make contributions to the construction and development of Shandong province.The thesis adopts methodologies as empirical research, contrast analysis, qualitative and quantitative analysis, and logic analysis.The innovations in the thesis are as follows: first, the thesis puts forward problems needed to be focused urgently; second, it makes a comprehensive research on laws and regulations, mechanism and system concerning the protection of rights and interests in Shandong province; third, it analyzes the shortcomings and its reasons existing in current protection. forth, some constructive suggestions are put forward on protecting rights and interests.
