A Study On The Dissent To Civil Execution In China

Civil execution means the course that the execution organs of people's courts adopt execution measures in accordance with the civil proce dure rules in order to make the citizens subjected to execution fulfill the obligations specified in legally effective documents. So, the power behind and compulsory nature of the execution make sense that the object of the execution is undeniable. In practice, however, imperfect execution can hardly be demolished completely. Illegal or improper execution action makes it difficult to avoid damage afflicted upon the parties or even the person related. Therefore, a dissent system specified for the execution is quite essential for the protection of the properties of the parties in the execution course. the new Civil Procedure Law, which came into force since 1 April 2008, has improved our dissent system for execution. As an execution officer who has been striving in the first line of the civil execution for quite a long time, this author starts this paper with the general analyst of the present system for execution dissent, then carries out a practical research of the daily exercises in his court, finally provides some suggestions to complete our civil procedure of dissent for execution.
