In our country, the legal rights of migrant workers are often treated unjustly and violated. As disadvantaged groups, they are easy to be discriminated in labor market. Because of uncertain laws, nonfeasance of local governments and lack of social support and attention, it's extremely hard to protect their own rights in regular ways. This thesis finds out that migrant workers protect themselves by means of irregular even abnormal resisting methods.This thesis points out that although these irregular measures which are outside structure have had effects, as the theory of Coser "social safety valve" illustrates, these resolutions which are outside system usually contain huge uncertainties, even big destructive effects, and they will be a big threat to social stability. This thesis brings forward some constructive suggestions in the end.This thesis focuses on the issues and results of migrant workers maintaining legal rights.First, it gives a brief introduction about background, significance and motive of the thesis. It makes a review of contributing documents and researches and gives the theoretical framework and relative concepts.The second part introduces the situation and aspects of migrant workers' rights being violated, and intrigue mechanism of maintaining rights. It gives a summary and also points out that some structural restraints in reality.The third part points out that due to imperfect law system, nonfeasance of local governments and lack of social support and attention, three-fold structural restraint of regular measures has been formed.The forth part summarizes that there are several methods for migrant workers to maintain rights with the normal ways being obstructed, mainly including daily resisting, seeking for non-governmental and social help and "alternative resisting" which consists of "self-destructive resisting" and "violent resisting". The former intents to draw attention by ways of self-injury while the latter makes damages by means of group violence.The fifth part divides resisting results into certain achievements and unsuccessful attempts, and then introduces the positive and negative social effects of these behaviors and suggests migrant workers to solve problems through regular and moderate ways.The sixth part points out that as disadvantaged groups, migrant workers are easy to be discriminated, and then explains our country hasn't taken the issue into system and it hasn't been formed into institutional and stable process. Last, it gives concrete advices in hope of contributing to this issue.
