Public Involvement In Local Administrative Legislation

Local administrative legislation is an important part of the country's legislation system, and it plays an important role in improving the system. Public involvement in local administrative legislation is not only an important way to spread democracy, but also an effective way to handle power and responsibility of the government, to realize'procedure justice'and to enhance the public's belief in law. In accordance to the development of the society, local governments of all levels have achieved a great success in legislation by'open legislation', enhancing the transparence of the legislation, exploring all kinds of methods and improving regulations of public involvement. They have found various methods for public involvement, for example: collecting written suggestions, convening legislation argumentations and hearings, organizing discussions on the internet, staring a helpline and making legislation assessments. As a result, the public are provided with much more methods for involving in the local government legislation. But there's no denying that there are still a lot of problems, the regulation system is not good enough; public involvement is at a low level and with less achievement than expected; the communication is not fluent enough; no interaction and feedback system in effective, etc. These problems lead to second thoughts and researches on public involvement in local government legislation.Judging form current requirements, research on public involvement in local government legislation is unsubstantial, which lays in lack of research paper on operable systems. This paper is a research paper on the legislation practice of Ningbo municipal government, which is based on the practice of public involvement in local government legislation. The paper starts from the concept and pattern of public involvement in local administration legislation and analysts the significance, theory foundation and the law origin in it. With reference to the practice in Ningbo, the paper probes into achievements, main characteristics and problems of current public involvement in local administration legislation and concludes the correlative reasons. The paper tries to find out ways to improve our country's communication system of public involvement in administration.There are 3 chapters in this paper. In the first chapter, the author defines the concepts of local administration legislation and public involvement and expresses the significance, theory foundation and law origin in it. In the second chapter, the author takes the practice in Ningbo for an example, sorts out the practice, characteristics and problems of public involvement in Ningbo municipal government legislation, and analyses the reasons objectively and subjectively. In the third chapter, the author focus on proposing ideas of how to execute public involvement in administration legislation in our country, and finds ways to improve our country's communication system of public involvement in administration. Urgent affairs facilitating effective and wide public involvement are: improve the interact-communication system between the public and local governments; make a criterion for the primary mode of suggestion-collect; develop the sense of communication for the public and governments; encourage agencies and communities to participate positively; and establish interact-communication platforms by taking advantage of the internet.
