About Special Investigative Measures Of Duty Crime

Duty Crime refers to the crimes committed by the personnel with a special status of duty, in which the crime is associated with their duty. Duty constitutes the premise and basis of a duty crime, and it is also differs the definition of duty crimes from other crimes. With China's social and economic development and reform in depth, our people live a better life, however,"Debauchery is a common vice among the wealthy". Corruptions continue to emerge, as Comrade Mao Zedong said: we can resist hail of bullets, but we cannot stop sugar-coated bullets. Many serving officers commit a duty crime by take advantage of their duty. Preventing corruption, controlling corruption, and combating corruption is the obligation of every Chinese citizen, especially the officers work at a procuratorial organ. Special investigation is an edged weapon to combat and control crimes. Therefore, in order to improve the ability of the prosecution's investigation, and deal with duty crimes more severely, China's special investigative measures must be innovative, and expand and deepen our battle against corruption to each primary unit so as to borrow the successful experience from other countries. As a prosecution officer, the writer elaborate the relevant concepts and characters of duty crime and special investigative measures base on actual work, and analyze the problems in investigating duty crimes and the status of the use of special investigative measures. The paper analyzes the defects of traditional crimes investigative measures, and the problems we use for special investigative measures in details, and proposes relevant recommendations and measures accordingly with the Intention of further improve the legislation so as to achieve the objective of combating such crimes effectively.The paper is divided in to three parts, the first part is the theoretical interpretation, which is mainly explained the related concept of duty crime and the special investigative measures. The second part describes the problem of the investigation of China's crimes and the application of special investigative measures to the status quo, which is analysis of the defects of the traditional routine investigative measures, and the problems we use for special investigative measures, the necessarily and feasibility of legislation, and analysis of special investigative measures from other country and learn from it. The third part is the innovation of this paper, the section presents the particularity based crimes and the problems, and proposes suitable measures in China's crimes legislation the concept of special investigative, which is intended to improve our ways and methods of investigative measures with the intention of combating such crimes and curb corruption and providing effective responses.
