China Mainland Domestic Violence Prevention Mechanism Perfection

With the development of the society and civilization, domestic violence has reached into the public field from the traditional individual domestic range. Domestic violence has become a widespread social phenomenon and is paid attention to all across the world, other than mere private affair. Although the definition of domestic violence in different countries are not the same, its severe harm to individuals, families, as well as the whole society is commonly recognized. Therefore, the international society has reached agreement on fighting against domestic violence and has accumulated rich experience in legislative and judicial practice. Taiwan district has built up a set of thorough domestic violence prevention system. Hong Kong and Macao district are also gradually establishing a unique anti-domestic violence social-support system. This thesis thoroughly researches the prevention system of domestic violence of Hong Kong, Macao and Taiwan of China and uses their rich legislative and judicial experience for references to make suggestions for China in this field, in order to build up a combined anti-domestic violence system of "prevention first, prevention combined with punishment remedy and education", which will have significant influence on accelerating the issue of anti-domestic violence law, promoting the process of fighting against domestic violence, as well as assisting in building up harmonious families and a harmonious society. This thesis will analyze from the following aspects about how to perfect China's anti-domestic violence system:Chapter one will introduce the basic theory of anti-domestic violence system, including the definition and prevention system of domestic violence. This chapter firstly introduces the definition of domestic violence by foreign countries, Hong Kong, Macao and Taiwan district; and then points out that the prevention system of domestic violence shall be a combined and interacted system which requires the endeavor of different levels, broad fields and various departments.Chapter two introduces and analyzes the current situation of anti-domestic violence system of mainland China, Hong Kong, Macao and Taiwan district. It will firstly introduce and analyze the anti-domestic violence system of mainland China and points out its shortcoming; secondly, this chapter thoroughly analyzes the anti-domestic violence system of Hong Kong, Macao and Taiwan district, describing their advantages; thirdly, this chapter mainly recommends the effective prevention methods of different districts from the perspectives of legislative and judicial practice, making a solid foundation for chapter three.Chapter three is the key chapter of the whole thesis, which will point out the necessity of perfecting China's anti-domestic violence system from the perspectives of value orientation transformation, the absence of particular anti-domestic violence law, as well as insufficient social assistance; and then uses comparative method to research the experience of Hong Kong, Macao and Taiwan district in anti-domestic violence field to propose some suggestions for mainland China; finally, chapter three will make various suggestions for China's anti-domestic violence system from the aspects of prevention, punishment, remedy and education.
