Study On Construction Of The System About Judicial Assistance Of Criminal Victims

The problem about judicial assistance of criminal victim has been attracted increasing academic attention, many scholars made a useful discussion of the meaning, nature and ways of the criminal judicial assistance. As the same time, our country is also gradually increasing the intensity of judicial assistance on criminal victim, and achieved good results. But it should be noted, China has not yet developed the criminal victim judicial assistance law presently, judicial assistance in criminal victim is still in the pilot initial stage, assistance program,object, scope, receive and review subjects had not uniform standard., which triggered a range of issues, making the rescue so far been ineffective. For these reasons, the article study on the criminal judicial assistance,to improve the study on the system of criminal judicial assistance.The article subject is divided into three parts content, the first part briefly introduced the reason, nature and significance of criminal victim judicial assistance, that judicial relief is conducive to safeguard human rights, the interests of justice and the realization of social harmony; the second part discussed the present situation of criminal victim judicial relief, the scope of judicial relief and so on, respectively described range of criminal victim judicial relief detail from the cases, the object, the amount and institutions and so on, trying to conduct theoretical exploration about the actionable for judicial relief; the third part discussed mainly the judicial assistance on criminal victim protection and means. In order to better achieve criminal victim justice, in order to build a socialist harmonious society, I believe that should be studied form the following aspects:the first is to establish and improve relevant laws and regulations; the second is to increase financial investment, broaden the sources of funds; the third is to vigorously implement the convergence of good judicial relief and other assistance system; the fourth is to strengthen the mediation efforts.
