A Study On The Circulation Of Rural Land Issues In Anhui

Agriculture is the basis of national economy. Agriculture is a strategic industry to stable nation. Since 2004, the "three rural issues", namely, agriculture, country side and farmers, is emphasized as the most important economic work. The farmers issue is the core issue of the "three rural issues", while the root of farmers issue is the land issue. Land is the largest social security of farmers, safeguard the fundamental interests of the farmers. As one of the major agricultural province of Anhui, farmers depend on the land for rehabilitate, the development of agriculture and rural depend on the farmland. However, with the development of economy and society, rural land is currently expanding in Anhui, but the survey found that farmer's interests were not completely protected, thereby hampering the process of rural land. Therefore, this paper studys the problem of rural land from the perspective of rights of farmers in Anhui Province, which has important practical significance.First, this paper maked full use of data and related information which obtained from 305 question surveys of famers in Feixi city, Yingshang city and Qingyang city in Anhui Province, and the National Statistics Bureau and Provincial Bureau of Statistics survey data in empirical analysis. Then we found that in the process of circulation of farmland in Anhui Province, procedures are not sufficiently standardized, the enthusiasm of farmers is not high enough, less transparent, small-scale, less or no social protection, low income. The principal in rural areas are women, children and olders, meanwhile, farmers are expecting the Government to help them.Second, the paper based on survey data and related analysis in rural areas. I first gave the definition of farmers, and pointed out that the concentrated expression of damage about the interests of farmers, including economic, political, cultural, education and employment. Then based on the Capabilities Theory to analysis the problem of farmer's rights in the process of circulation of farmland. As the facts have proved that farmers as a vulnerable group can not fully protect their economic interests, political rights, employment rights, education rights, social security rights and interests, to some extent, and can not guarantee the safety of their homes, rural cultural heritage. So the Government must protect the interests of farmers, admit the farmers share the "cake", so that the society's "cake" will become bigger and bigger.Third, the paper based on the perspective of the poor protection of farmer's rights and interests in Anhui Province, I pointed that, if we expect it transfer reasonablely, circulation of farmland must have five main conditions. When these five conditions are fulfilled, the land can reasonably circulate and satisfy the farmer's willness; at the same time, analysising the functions of land equivalent to the ordinary farmers is the natural world to the sun, the land has a natural function of social security. The more tension between people and land, the more important of farmland, farmland committed to the social security function of the peasant population is more than its function of production. Farmland is the "umbrella" of each farmer, if the "umbrella" is changed, at least the relevant departments must give other compensation.Fourth, the paper draw domestic and international measures to protect the rights and interests of farmers, and give the proposed measures---Government-led, integrated, multi-pronged, comprehensive protection of the rights and interests of farmers, and establishing and improving the laws and regulations, to protect the rights and interests of farmers. The system of protection of farmer's rights is as a "social safety net" and "shock absorber", so its reform and improvement, is not only an important content to build a harmonious society and a new socialist countryside, but also urgent requirement to promote the transfer of rural land use right reasonably.Finally, the paper took the following methods to study, such as the questionnaire survey and field interviews, standardized analysis and empirical analysis, theory and practice. The points of Innovation are through field survey to get data and information about the status of rural land, farmers living conditions and safeguardness of the interests of farmers to compensate for the lack of empirical research about the protection of farmer's rights in the current academic, meanwhile, the paper may provide the feasibility of the reference for Governments.All in all, the farmland is the largest social security for farmers. The most important safeguarding the fundamental interests of the farmers is to maintain land rights. Land is not only the interests of farmers, but also the interests of our country. The fact is that more population, less farmland. Circulation of farmland should respect the wishes of farmers.
