The Research Of Land Rights Protection Of Framer Durinfarmland Circulation

Currently in China rural social and economic development has entered a stage of transition. Farmland circulation, which has become a necessary choice to speed up the development of modern agriculture in our country, is important grippers to promote reform of the rural land system and rural economic development. The core problem of farmland circulation is to protect and realize the land rights of framer. Judging from the present condition, there exist several problems of damaging farmland circulation during farmland circulation which lead to affect the enthusiasm of the farmers involved in land circulation and hinder the process of farmland transfer and the development of modern agriculture. The reasons for the results are various, such as incomplete rural land market lacked land property rights, diseased guarantee mechanism of farmland circulation market.Recently a number of domestic scholars focus on the land rights protection of framer during farmland circulation. But the research on land rights protection of framer during farmland circulation from the perspective of protecting property rights of land contract management right and land property rights is not much. Based on theoretical analysis of land rights protection during farmland circulation, this paper chooses380peasants in suburban areas in Chizhou City as the research object, then analyses specific characteristics of farmland circulation. This paper deeply analyses the following three aspects, which include the protection status of land rights, the damaged status of land rights and the damage reasons of land rights. Main research conclusions are as followings.(1) During the process of farmland circulation in suburban areas in Chizhou City, farmers can’t own the full land contract management right, the complete land circulation disposition right, the reasonable profit right of farmland circulation.(2) There are several reasons for impaired land rights of farmer in suburban areas in Chizhou City, such as inexistent subject of rural collective land ownership, dominant status of land property rights, weak consciousness of farmer land rights, incomplete mechanism for setting prices of farmland circulation, the lagging registration of land contract management right, faulty supporting mechanism of farmland circulation.(3) It is concluded that several measures should be taken to promote the development of farmland circulation for protecting farmers’ land rights, such as perfecting the rural land property rights system, innovating farmland circulation patterns, building operation guarantee mechanism of farmland circulation, accelerating the construction of farmland changing market and perfecting government behavior of farmland circulation.
