Perspective From The Environmental Rights On Environmental Protection For The Development Of Coal Resources In Xinjiang

In March 2008, the State Council issued 'The Several Opinions of On Further Promoting Economic and Social Development in Xinjiang', has proposed Xinjiang will become the 7th largest national program formed one of the coal chemical industry zone which based in Large-scale coal bases, to development of deep processing of coal in order, to improve the strategic position of Xinjiang Coal up to 2020.'Eleventh Five-Year Plan of Xinjiang' clearly states: it will develop coal and coal chemical industry vigorously. Xinjiang Coal Industry becomes one of the important industries. Because the special geography and climate in Xinjiang, the unreasonable development of mineral resources make the original fragile ecological environment has been seriously damaged many years before. Environmental degradation will affect the economic development and local residents including ethnic minorities living environment. To develop the coal industry in Xinjiang, how to make the original areas of water shortage to match the coal development.With theories of related disciplines, such as law and ethnology, employing the methods of regulation study and case study.the current research mainly focuses on the environmental protection of the development of coal resources in Xinjiang from the environmental rights. To take the rational development of coal development in Xinjiang, optimize resources and achieve the unity of economic and ecological benefits. There are seven parts in this thesis: introduction, fiver parts and conclusion.Introduction proposes the research setting, then sums up and analyses the interrelated studies in domestic and abroad. The current also introduces the basic research framework, research methods and theoretical and practical significance.In the first part, described the concept content and features of environmental rights, proposed the characteristics of environmental Rights in coal development.The second part introduces status of coal resource, the development of coal industry.The third part described the implementation status on Environmental Rights in the legal status of coal resources in Xinjiang. For example, the actual situation in the use rights on environmental resource, the participation right, and so on.In the four part, described the legal status of coal resources in Xinjiang, and proposed a lawful system to promote the environmental rights for protect the environment on coal development.The five part, in researching of the establishment of ecological compensation system in Xinjiang coal development.Conclusion mainly performs the summary of all the chapters and presents the main viewpoints innovations and insufficiencies of the current dissertation. This part also points out those which the dissertation has not profoundly discussed and the interrelated questioned which need further studies in the future.
