Since the reform and opening up, real estate brokerage has been facing a historic opportunity for development. Its rapid development provides a great convenience for the sale and lease of property, but also helps reduce the development risk for the developers and social transaction cost, makes the real estate market to be prosperous and active, and promote real estate circulation. As a result, the broker becomes a necessity of the real estate industry.However, with the rapid growth in the process of the real estate brokerage industry, there are serious problems in the laws and regulations relating to real estate brokerage because of their lagging behind time or even absence, thus the real estate brokerage could not get the protection and regulation of due laws, real estate brokerage management exposed many deficiencies, which will affect the healthy development of the real estate brokerage industry itself, but also breeds a lack of credit and other social issues relating to real estate brokerage.In order to solve these problems, many scholars began to study the real estate brokerage management system of the United States that is quite perfect, attempting to learn from the experience of the U.S. brokerage industry, but the effect is poor. The reason is the lack of a complete system of the study of the real estate brokerage management legal system in the U.S. and the feasibility of borrowing it to China, and most of the researches are comparative studies from the aspects of economics or management, while research on legal issues are sporadic, and scattered in the researches of other areas, and less effort has been made to conduct a comparative study of the Sino-US Real Estate Brokerage system from the perspective of law study.This paper studies the U.S. real estate brokerage management from a legal perspective. With an eye on the actual situation in China, this paper attempts to compare the legal system of the real estate brokerage management in China and the U.S., and offer some suggestions for China to learn from the U.S.
