Shanghai Municipal Government began in July 2004 from the homestead replacement pilot, but there are some problems in the implementation process, so the need for detailed land use right transfer research, especially empirical research.In this study, reference to domestic and foreign research and analysis on the basis of the existing system, through the land use right transfer for game analysis, a summary evaluation of the pilot, and Jiangqiaozhen happy village, for example to conduct field research, demand from the farmers point of view, the transfer of land use right will conduct empirical research.I believe that allowing the transfer of land use right of the stakeholders (government, the rural collective economic organizations and residents, developers) are beneficial, in order to fully take care of the interests of residents, the Government should improve the supervision system, and actively guide the enterprises to participate in the transfer of land use right give full play to market allocation of land resources, capabilities, and farmers land use rights transfer to ensure the security gains, the pursuit of value-added revenue maximization, and the Shanghai municipal government departments need to further improve the land use right transfer of the relevant laws and regulations. Also recommended the establishment of a unified market and a sound service system, improve market regulations and trading rules, to establish a rational land use rights transfer in rural income distribution mechanism, improve the rural land use planning and town planning, planned, step by step to promote homestead use rights transfer, and flow control policies and systems to enhance revenue regulation, continue to promote the integration of urban and rural social security system, innovation and collective economic organizations model, improve relevant laws and regulations to promote the legal publicity.
