State-owned assets are material basis for Chinese socialist system's survival and development and they are also the economic lifeline in our country. As an important part in socialist public ownership, they have decisive elements on socialist market economy. In recent years, however, the state-owned assets are drained away at an amazing rate, which directly affects the economic layout and structure of the state-owned economy, furthermore, it also weakens the state-owned economy's vitality, controlling force and influence. So, it should not be neglected during the development of the socialist market economy. We must stop this kind of thing immediately. Adhering to the theory with practice and realistic attitude, basing on the comparative analysis about the theory of Marxism's ownership, western economics theory of property rights and China's socialist market economy theory, we pursue the theory on state-owned assets management and reform and expect to establish a system to provide theoretical reference and related legislation Suggestions. We believe that these methods have great significance on the effective management of the state-owned assets loss and they can achieve maximum benefit. On the basis of the concept of a scientific definition of state-owned assets of enterprises in science and the loss of state-owned assets, this paper analyzes the causes of the loss of state-owned assets in many aspects. It seeks the progress and shortages of protection on state-owned assets from the angles of economic legislation, administrative legislation and criminal legislation. It will also propose laws and regulations on the loss of state-owned assets problem from economic law, administrative law and criminal law.
