China has taken a part in the WTO ten years since 2011.In the 10 years,the average tariff has down from 15.3% in 2001 to 9.8% and more than 100 service department have been set up for the trade; the export & import scale have increased 4.9 folds and 4.7 folds;the GNP has grown up more than 2 folds. "the ten years that China in WTO is the ten years that China enjoy the prosperity and achieve the win-win situation with the whole world",Deming Chen,the Commerce Minister of China, said in the World Economic Forum in Daws on 27th Jan 2011.Decades, China's economic development and progress of the great achievements for all to see, the process of China's market has also been significant development. From denying the market economy status of China at the first, to four countries in 2004, which is New Zealand, Singapore, Brazil and Malaysia; 9 countries in2005; 77 countries in 2008; 97countries in 2009, there are more and more countries admit the market economy status of China. Unfortunately, these recognitions don't hinder the past 15 years China has become the one who subject to the most anti-dumping investigations in the world, and the initiate are most of the major trading partners; the USA is the head of them. It took China and America a long time on the China market economic status issue when the two sides negotiated it. And China made a concession that "China's market economy status con not be admit until 2016". The ten years accession to the WTO, China has also negotiated with the United States on this issue several times, hoping to shorten the relevant period, as soon as possible to admit the market economy status of China to minimize trade friction between China and the U.S. But with the 2007 U.S. subprime mortgage crisis and the global financial crisis, the global trade protection began to rise. The United States also launched a massive anti-dumping and anti-countervailing investigations to China, while due to the "non-market economy status" label at the top, China's export enterprises often has in responding to the passive position, which is non-appearing of defeat. The label of "non-market economy status" has had a tremendous impact to China's export trade. Three Sino-US strategic economic dialogue, the America had an active attitude to recognize the China's market economy status as soon as possible,which means that China is expected to advance the status of market economy countries to enjoy the treatment or the United States blindly diplomatic trick? In the thesis, the fourth &fifth chapters have an analysis in political economy wan on this issue.The paper has a relatively systematic analysis on the "non-market economy status" issue.There are six chapters in the paper. The first chapter is the introduction, the topics of the background and the research purposes, theoretical and practical research situation, and had a introduction. The second chapter describes the rules of non-market economy status origins, are divided into two levels, the first section discusses the generation of non-market economy status and the GATT Article VI of the Notes,the second parts is about the detail between China and America on non-market economy status origin of the problem;ChapterⅢ, this article further describes China and the United States for non-market economy status of the relevant provisions. The first level is the U.S. anti-dumping laws in countries of the non-market economy status and the associated estimates of normal values rules requirements;the second level introduces rules of anti-dumping in article 15 of the "China WTO Accession Protocol" and dose some analyses; Chapter IV, article analyzes the nature of Sino-US non-market economic status,in two aspects which are the politicization of economic issues and for the real purpose of the trade-protecting; Chapter V, introduce the foreign trade, domestic economic development and the impact on the China internal affairs in three aspects and the adverse effects to China; In the last part of the article is the sixth chapter,put forward relevant polices and measures, and in turn from government functions and enterprise functions to be discussed.
