Since China successfully joined the World Trade Organization in 2001,China has been actively developing international import and export business,and its economic development is very fast.However,China has been plagued by discriminatory anti-dumping clauses,and it is easy to encounter trade relief surveys in the world,especially in the United States.Among them,“non-market economic status” has become an important non-tariff barrier for Chinese products in other countries.The export of Chinese products is easily judged to be a high dumping margin,and high anti-dumping duties are expropriated.The United States frequently applies the anti-dumping clause to accuse Chinese products,which has a great impact on the export of Chinese products.The United States plays a leading role in formulating the WTO's trade rules.The existence of the terms of China's “non-market economy status” is also related to the US.Therefore,the study of the impact of“non-market economic status” on China's anti-dumping measures in the United States is of great practical significance to our country's early solution of the “non-market economic status” and the promotion of Sino-US trade development.This paper is devoted to the study of the impact of “non-market economic status”on China's anti-dumping in the United States through empirical and case studies,and puts forward suggestions to the government,industry associations and enterprises according to the conclusions.In the case of empirical analysis,this paper analyzes the case of American antidumping in the 20 years from 1995 to 2015,and verifies the relationship between the “non-market economic status” and the results of the anti-dumping decision,and the relationship between “non-market economic status”and the anti-dumping duty of the United States,and draws a conclusion: There is no inevitable relationship between the “non-market economic status” and decisions of dumping.However,in determining the existence of dumping,the “non-market economy status” is related to the decision of the tax rate.The thesis is divided into six chapters:The first chapter mainly explains the background and significance of the research,analyzes the research status at home and abroad,introduces the research contents and methods of the article,and summarizes the innovation and shortcomings of the paper.The second chapter introduces the rules of “non-market economic status” in the United States and analyzes the impact of its provisions on China.It explains the relevant concepts,the provisions of the “non-market economic status” in the anti-dumping law of the United States and analyses the influence of its provisions on China from four aspects.The third chapter mainly introduces the origin of Sino-US non market economy status and the status quo of China's “non-market economy status” and the situation of US anti-dumping.The fourth chapter is the empirical analysis of the effect of “non-market economic status” on China's anti-dumping measures in the United States,and studies the relationship between the “non-market economic status” and the results of antidumping adjudication,the “non-market economic status” and the anti-dumping duty.The fifth chapter carries out a case study,taking the case of the anti-dumping case of China's photovoltaic products in 2011 as an example to study how the“non-market economic status” affects anti-dumping.The sixth chapter puts forward the countermeasures and suggestions to deal with the “non-market economic status” and the anti-dumping measures in the United States,including the countermeasures and suggestions to the government,the domestic industry association and the enterprises,so as to improve our country's response to the“non-market economic status” and the US anti-dumping measures.
