Study On Legal System Of Property Right Of Natural Resources In Transformation Of Resource-based Economy

China has made remarkable achievements since the reform and opening up in1978, but with the deepening of reform and opening up, the contradiction between China’s resource-based regional model of economic development and natural resource consumption patterns are becoming increasingly prominent, seriously affect the smooth development of the national economy, and therefore become an urgent strategic issues. At present, resource-based economy is primarily in developing countries, some developing countries in the large-scale industrialization and the rapid modernization process, the terms of trade on a large scale and wide-ranging, deep-seated constantly worsening, industrial structure is less and less reasonable, a serious imbalance is in the distribution of wealth and the management of natural resources is our of control. This is a morbid state of development process, this "pathological" process is often manifested as a resource endowment advantage of the large number of developing countries into the advantages of competition and development. The key to address this strategic issue is transformation of economy development. While the resource-based economy is to achieve a smooth transformation, there must be reasonable and effective property right system of natural resources. Therefore, I hope that through in-depth analysis of the problems faced by China’s resource-based economic development and the status of property right system of our natural resources. Finally put forward suggestions to perfect property right system of our natural resources in transformation of the resource-based economy.This article is composed by the introduction, the body, the conclusion. The text is divided into four parts. The first part is to analyze the property right theory of natural resources.The second part is to analyze the reasons and requirements of the resource-based economic transformation.The third part is to analyze the history of property right system of our natural resources, current situation and defect.Through analysis of property right system of our natural resources, I found that property right system of our natural resources can not meet the requirements of resource-based economic transformation.The fourth part is some suggestions on how to perfect property right system of our natural resources in the transformation of the resource-based economy. Hope these suggestions to make property right system of our natural resources to meet the requirements of resource-based economic transformation, thus conducive to the smooth transformation of resource-based economy, to achieve economic, social and environmental sustainable development.
